Terms of service

These terms apply to your use of the Neon Skies online store and to any purchase you make. By placing an order you agree to them. Neon Skies is based in Katoomba, New South Wales, Australia.

  1. Products and availability. We sell collectible trading cards, graded cards, sealed product, retro consoles, games and related collectables. Many items are single-quantity and one-of-a-kind. Listing a product is not a guarantee it stays available; if an item is unavailable after you order, we will contact you and refund.
  2. Pricing and GST. All prices are in Australian dollars and include GST where applicable. We aim to keep pricing accurate, but if a price is clearly wrong we may cancel the affected order and refund you.
  3. Orders and acceptance. Your order is an offer to buy. We accept it when we dispatch the item or confirm pickup. We may decline or cancel an order, for example for suspected fraud, a pricing error or a stock issue, and will refund any payment.
  4. Payment. Payment is taken at checkout through Shopify's secure payment processing. We do not store your full card details.
  5. Condition and descriptions. We describe items honestly, including condition, finish and, for graded cards, the grading company, grade and certification number. Photos form part of the description. Graded cards reflect the grading company's opinion as shown on the slab.
  6. Your consumer rights. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. See our Refund and Returns Policy.
  7. Shipping. See our Shipping Policy. Risk in the goods passes to you on delivery.
  8. Intellectual property. Pokémon, trading card game names, and console and game trademarks and imagery belong to their respective owners. We sell genuine collectible items and are not affiliated with or endorsed by those rights holders. Site content, including text, layout and our own photography, belongs to Neon Skies and may not be copied without permission.
  9. Acceptable use. Do not use the site unlawfully, attempt to disrupt it, or scrape it for resale data.
  10. Liability. To the extent permitted by law, and subject to your rights under the Australian Consumer Law, Neon Skies is not liable for indirect or consequential loss arising from use of the site or products.
  11. Governing law. These terms are governed by the laws of New South Wales, Australia.
  12. Changes. We may update these terms. The version on the site at the time of your order applies.
